Terms for site utilities

1. What this is
AI Shelf Check and any other item on the Tools page (each a “Utility”) are automated drafts. They are templates and checklists generated from public page text you supply and from a language model. They are not an audit, strategy, legal opinion, medical opinion, regulatory filing, SEO guarantee, or advertising substantiation file.
Running a Utility does not create a client, advisory, fiduciary, or employment relationship with Stephanie Kang, Growth Spread, or any affiliated company (together, “we”). Live growth work is only by separate written engagement via Contact. Tools never display advisory fees, and use of a Utility is not a paid service.
Outputs are not written or reviewed by Stephanie Kang unless a signed engagement says otherwise.
2. No professional advice
Nothing on a Utility is legal, medical, clinical, tax, accounting, or regulatory advice. Cosmetics, OTC drugs, devices, and advertising are regulated in the United States (including by the FTC, FDA, state attorneys general, and self-regulatory bodies such as NAD). Korean MFDS / functional-cosmetic wording does not travel as US proof. Amazon, Shopify, TikTok Shop, and retailer style guides are their own rules. You must have qualified counsel and quality review before you publish, list, or advertise.
3. Scores and engines
The numeric score is a heuristic checklist (entities, opening copy, headings, schema, robots, llms.txt, shopping facts, US claim language). It is not a measurement of traffic, rank, citation probability, conversion, or compliance. ChatGPT, Perplexity, Google AI Mode / AI Overviews, Amazon Rufus, and similar systems are third parties. We do not operate them, do not have their ranking data, and do not promise they will read, cite, recommend, or sell your product. We are not affiliated with OpenAI, Google, Amazon, Perplexity, Apple, Meta, or their trademarks, which remain their owners’.
4. Your inputs
You represent that you have the right to submit each URL and each product line, and that the URL is a public http(s) page. Do not submit passwords, unpublished clinical data, customer lists, personal data of others, trade secrets you cannot share with a model provider, or pages behind a login. We fetch only the address you paste, plus that origin’s robots.txt and llms.txt, and we block private or non-public hosts. Fetching may fail, be incomplete, or violate a third-party terms of use — that risk is yours. We do not bypass paywalls, CAPTCHAs, or authentication.
5. Models and copies
Submitted text and fetched public HTML may be sent to a language model to draft queries, PDP lines, FAQs, Amazon-style bullets, and an llms.txt. Model output can be wrong, stale, incomplete, generic, or similar to other public text. It may invent or overstate claims despite instructions not to. Amazon bullets are not Amazon-approved. “Copy-ready” means the text is formatted to paste, not that it is cleared for live use.
You are solely responsible for verifying ingredients, INCI, net contents, performance claims, “free-from” language, skin-type statements, comparisons, prices, and retailer policies before publication. Do not treat a draft as substantiation.
6. License and IP
You keep whatever rights you already have in your inputs. Subject to these terms, we grant you a non-exclusive license to use the draft output for your own brand’s internal review and, after human clearance, customer-facing copy. We do not claim copyright in short machine-generated fragments, and we do not warrant that output is unique or non-infringing. You must not imply that Stephanie Kang, First Aid Beauty, P&G, L’Oréal, or any named past seat endorses the product you ran.
7. Privacy
Utilities do not create an account. We do not intend to store runs as a customer file. Model providers and hosts process data under their own terms. See Privacy. Do not submit information you cannot send to a processor.
8. As-is; liability
Utilities are provided “as is” and “as available,” without warranties of any kind, including merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted access. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost listings, regulatory fines, or claim challenges, arising from use of a Utility. Our aggregate liability for a Utility is limited to USD 0, because the Utility is free and is not an engagement. Some jurisdictions do not allow certain limitations; in those places our liability is limited to the minimum the law requires.
You agree to defend and hold us harmless from third-party claims arising out of copy, listings, or ads you publish after using a Utility, except to the extent caused by our willful misconduct.
9. Acceptable use
No scraping of this Utility at a volume that degrades the service, no resale of raw model output as “Stephanie Kang audits,” and no use to generate deceptive claims, impersonation, or content about minors.
10. Law
These terms are governed by the laws of the State of New York, excluding conflict-of-law rules. Exclusive venue is the state or federal courts located in New York County, New York, except that we may seek injunctive relief anywhere. If a section is unenforceable, the rest remains. We may update this page; the dated version at the time you run a Utility applies to that run.
